Delivery Terms

1. Scope & Relationship to Other Policies
These Delivery Terms apply to wholesale orders confirmed by Tayfun Silver Wholesale and should be read together with:
- Payment & Returns Policy,
- Shipping Policy,
- Warranty & Returns Terms,
- Sales Agreement and Terms & Conditions.
In case of conflict, specific terms stated in your pro-forma invoice, Sales Agreement or written contract will prevail over these general Delivery Terms.
2. Incoterms® & Delivery Basis
The point at which risk and certain costs transfer from Tayfun Silver Wholesale to the buyer depends on the agreed Incoterms® and logistics setup. The applicable basis (for example EXW, FCA, CPT or other) will be indicated on:
- Your quotation or pro-forma invoice,
- Your order confirmation, and/or
- The commercial invoice attached to the shipment.
Where no Incoterms are explicitly stated, the default interpretation will be the one reasonably consistent with the shipping method and the responsibilities described in our Shipping Policy.
3. Production Lead-Times vs Delivery Time
- Production lead-times cover the period from order confirmation and payment clearance until the goods are ready for dispatch from our facility.
- Delivery or transit time covers the period from dispatch to the first delivery attempt at the address provided by the buyer, subject to customs and local conditions.
- Any lead-times communicated in our offers or order confirmations are indicative and assume normal operations and timely approvals from the buyer.
- Changes to designs, quantities, plating, gem colours or sizes after confirmation may extend lead-times and affect delivery dates.
4. Indicative Schedules & Cut-Off Times
- Tayfun Silver Wholesale will provide an estimated production and dispatch window at the time of order confirmation or as part of the pro-forma invoice.
- Dispatch is usually organised on working days only and may be subject to carrier cut-off times, local holidays and operational capacity.
- Orders for which payment or final approval is received after the agreed cut-off time may be automatically shifted to the next production or dispatch cycle.
5. Delivery Attempts & Receiver Obligations
- The buyer is responsible for ensuring that someone authorised is available at the delivery address during normal courier delivery hours, unless a different arrangement is agreed with the carrier (for example, scheduled appointment).
- Carriers may attempt delivery more than once, or route the shipment to a local facility or service point if the receiver is not available.
- If deliveries are repeatedly unsuccessful due to absence of the receiver or refusal, storage fees, return charges or additional handling fees may apply and can be charged to the buyer.
- You should monitor the tracking information provided and contact the carrier promptly if re-delivery or address clarification is required.
6. Partial Deliveries & Backorders
- For operational reasons, we may dispatch an order in multiple parcels or partial shipments (for example, to meet weight limits or to send ready items earlier).
- Where a product is temporarily unavailable or under revision, we may propose: partial fulfilment, substitution with a similar model or placement on backorder.
- Partial shipments do not release the buyer from the obligation to pay the full order amount, unless a written agreement specifies a different approach.
- Any backordered items and their expected delivery schedules will be communicated separately.
7. Inspection on Arrival
Upon delivery, the buyer is obliged to inspect the shipment, outer packaging and products immediately, in accordance with the Warranty & Returns Terms.
- If any visible damage is identified on the outer packaging or parcel at the time of delivery, including but not limited to crushing, tearing, opening, moisture, deformation, impact marks, signs of tampering or similar defects, the buyer must prepare an official damage report together with the carrier personnel at the time of delivery. Where possible, such damage should also be noted on the carrier’s delivery record.
- The buyer should also take clear photo and video evidence showing the condition of the shipment at the time of delivery and submit the relevant notification without delay, together with all available supporting documents, including shipment details, item codes, quantities and any other relevant records.
- After opening the shipment, the contents must be checked within 72 hours in accordance with the Warranty & Returns Terms for quantity, model, plating, gem colour and any other relevant specifications. Any discrepancy, shortage or suspected manufacturing fault must be reported within this 72 hours period, together with clear photos, item codes and quantities.
- If visible damage exists but no official report is prepared at the time of delivery, sufficient supporting evidence is not provided, or the notification is not submitted properly and without delay, the relevant claim may be rejected or may not be taken into evaluation.
- Until the inspection and review process is completed, the products, packaging, original boxes, labels and their physical condition at the time of delivery must be preserved. Any repackaging, alteration, removal of contents, damage or other intervention after delivery that makes it difficult to determine the original condition of the shipment may result in rejection of the claim.
- Where deemed necessary, Tayfun Silver Wholesale may request that the relevant products be physically sent for inspection, verification, regulatory, customs or similar operational processes. However, no product may be returned or shipped without our prior written approval.
- Tayfun Silver Wholesale shall have the sole discretion to determine whether physical inspection is required, whether any return procedure will apply and how the matter will be handled. Any request for physical inspection does not, by itself, constitute acceptance of any defect, shortage, liability or return.
8. Tolerances & Acceptable Variations
Wholesale jewellery manufacturing involves certain technical tolerances. Within the tolerances defined in our Warranty & Returns Terms, variations such as the following may be considered acceptable and not a delivery defect:
- Minor deviations in gram weight within agreed percentage ranges,
- Slight variations in plating tone, gemstone shade or handcrafted details, consistent with normal production processes,
- Reasonable differences in packaging presentation, provided the items are protected and correctly labelled.
Where tolerances are explicitly mentioned on quotations, pro-forma invoices or product documentation, those specific values will prevail.
9. Delays, Force Majeure & External Factors
- Tayfun Silver Wholesale is not responsible for delays in delivery caused by events outside of our reasonable control, such as natural disasters, strikes, war, regulatory changes or large-scale carrier disruptions.
- Customs inspections, security checks or other regulatory controls at borders may extend transit times independently of our actions.
- In case of significant disruption, we will communicate in good faith with affected buyers and explore practical alternatives where feasible.
10. Governing Framework
These Delivery Terms form part of the overall contractual framework between Tayfun Silver Wholesale and its trade partners. The governing law, dispute resolution mechanism and jurisdiction are determined by the applicable Sales Agreement and Terms & Conditions.
In all cases, our objective is to deliver orders safely, transparently and with clear communication throughout the production and shipping process.
